Applies To: All physical products sold by TEKPOLY, including existing and forthcoming product lines, purchased in the United States from TEKPOLY or its authorized retailers.
This document consolidates TEKPOLY’s Limited Warranty, Return Policy, Product Safety, Compliance & Liability Disclaimers, and General Legal Disclosure governing the purchase and use of TEKPOLY physical products. It does not cover website cookies or online privacy practices, which are addressed separately in TEKPOLY’s Cookie Notice and Privacy Policy.
By purchasing, receiving, or using any TEKPOLY physical product, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to the terms set forth below. To ensure compliance with applicable state consumer protection laws, TEKPOLY requires customers to affirmatively acknowledge receipt of this Policy—including the Return Policy set forth in Section 2—before completing any purchase transaction. Such acknowledgment will be recorded with the date and time of acceptance. Failure to present this Policy prior to the completion of a transaction (i.e., before money changes hands) may constitute a defective trade practice under certain state laws and expose TEKPOLY to regulatory action, fines, or consumer protection claims.
1. TEKPOLY Limited Warranty
1.1 Coverage
TEKPOLY warrants that, under normal and intended use, each TEKPOLY-branded physical product will be free from material defects in workmanship and materials for the warranty period specified on the product’s listing page, packaging insert, or accompanying documentation at the time of original purchase (the “Warranty Period”). If no warranty period is specified for a given product, the default Warranty Period is two (2) years from the date of original retail purchase.

During the applicable Warranty Period, TEKPOLY will, at its sole discretion and as the exclusive remedy available to you under this Limited Warranty:
Replacement parts, repaired products, or replacement products are warranted for the remainder of the original Warranty Period or ninety (90) days from the date of repair or replacement, whichever is longer.
1.3 What Is Not Covered
This Limited Warranty does not cover, and TEKPOLY shall have no obligation to repair, replace, or refund, any product or condition arising from:

To submit a warranty claim, contact TEKPOLY Customer Support at the contact details published on _____________ and provide:
TEKPOLY reserves the final and sole right to determine, based on the evidence submitted and any further inspection, whether a claim qualifies for benefits under this Limited Warranty and which remedy (repair, replacement, or refund) to provide. TEKPOLY may require return of the defective product, at TEKPOLY’s expense for shipping within the contiguous United States, before a remedy is issued.
1.5 Exclusive Remedy; Disclaimer of Implied Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE REMEDIES SET FORTH IN THIS SECTION 1 ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH OF WARRANTY. EXCEPT FOR THE EXPRESS LIMITED WARRANTY STATED ABOVE, TEKPOLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WHERE IMPLIED WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, SUCH WARRANTIES ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD. SOME U.S. STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
2. TEKPOLY Return Policy (60-Day Return Window)
TEKPOLY offers a sixty (60) day return policy on eligible physical products purchased directly from TEKPOLY. This Return Policy is separate from, and does not limit, your rights under the TEKPOLY Limited Warranty set forth in Section 1.
2.1 Eligibility
To be eligible for a return under this Section 2, the product must:
Products purchased from authorized third-party retailers must be returned to the original retailer in accordance with that retailer’s return policy. TEKPOLY does not directly process returns for purchases made through third-party sellers.
2.2 How to Initiate a Return
To initiate a return within the 90-day window, contact TEKPOLY Customer Support at info@tekpoly.com with your order number and the reason for return. TEKPOLY will:
Returns sent without a valid RMA number or postmarked more than sixty (60) days after the original purchase date may be refused or subject to a restocking fee.
2.3 Non-Returnable Items
The following items are not eligible for return under this Section 2, except in the case of a verified manufacturing defect covered by the Limited Warranty in Section 1:
2.4 Refunds, Restocking Fees, and Shipping Costs
Once a returned product is received and inspected, TEKPOLY will notify you of the approval or rejection of your refund. If approved, refunds will be issued to the original payment method within a reasonable time, typically within ten (10) business days following inspection.
2.5 Exchanges
TEKPOLY does not process direct product exchanges. To exchange an eligible product, please return the original item in accordance with this Section 2 and place a new order for the desired item.
2.6 Damaged, Defective, or Incorrect Items
If you receive a product that is damaged in transit, defective, or different from what you ordered, contact TEKPOLY Customer Support at info@tekpoly.com within thirty (30) days of delivery. TEKPOLY will, at its discretion and at no additional cost to you, arrange for replacement, repair, or refund in accordance with this Return Policy and the Limited Warranty.
3. Product Safety, Compliance, and Liability Disclaimers
3.1 Intended Use
TEKPOLY products are designed, manufactured, and tested for personal, residential, and (where expressly designated) commercial use in accordance with the specifications, instructions, weight limits, age recommendations, and assembly guidance set forth in the product’s user manual, packaging, and listing page. You agree to use TEKPOLY products only for their intended purpose and in accordance with all accompanying documentation.
3.2 Assembly, Installation, and Safe Use
Many TEKPOLY products require assembly or installation prior to use. You are responsible for:
Failure to follow these instructions may result in personal injury, property damage, or product failure, and may void this Limited Warranty.
3.3 Regulatory Compliance
TEKPOLY designs its products to comply with applicable U.S. federal, state, and local product-safety, electrical, materials, labeling, and consumer-protection laws and regulations in effect at the time of manufacture, including, where applicable, standards administered by the U.S. Consumer Product Safety Commission (CPSC), the Federal Communications Commission (FCC), and the Federal Trade Commission (FTC). Where a TEKPOLY product carries an FCC, UL, ETL, CARB, California Proposition 65, or similar marking or notice, the corresponding regulatory information is provided on the product, its packaging, or its accompanying documentation. Customers are responsible for complying with any additional laws, regulations, building codes, or homeowner/association rules applicable to the installation or use of the product at their location.
3.4 No Medical, Safety-Critical, or High-Risk Use
Unless a TEKPOLY product is expressly labeled and marketed for such use, TEKPOLY products are not designed, intended, or authorized for use in medical, life-support, life-sustaining, safety-critical, aerospace, nuclear, automotive control, or other high-risk applications where failure of the product could reasonably be expected to result in personal injury, death, or significant property or environmental damage. Customer assumes all risk and liability for any such use.
3.5 Assumption of Risk
You acknowledge that use of any physical product carries inherent risks, including the risks of personal injury and property damage. To the fullest extent permitted by applicable law, you knowingly and voluntarily assume all such risks in connection with your use of TEKPOLY products, including risks arising from assembly, normal use, environmental conditions, and interaction with other products or persons.
3.6 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEKPOLY, ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR AUTHORIZED RETAILERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE GOODS OR SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE), ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE, POSSESSION, OR USE OF ANY TEKPOLY PRODUCT, EVEN IF TEKPOLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TEKPOLY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO A TEKPOLY PRODUCT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PRODUCT THAT IS MOST CLOSELY RELATED TO YOUR CLAIM. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF ANY WARRANTY OR REMEDY PROVIDED UNDER THIS POLICY FAILS OF ITS ESSENTIAL PURPOSE.
SOME U.S. STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
3.7 Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TEKPOLY and its parents, subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers, and authorized retailers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your misuse, modification, or unauthorized repair of any TEKPOLY product; (ii) your violation of this Policy or of any applicable law; or (iii) your negligent or wrongful acts or omissions in connection with a TEKPOLY product.
4. General Legal Disclosure
4.1 Scope
This General Legal Disclosure governs the purchase, ownership, and use of TEKPOLY physical products in the United States. It does not cover TEKPOLY’s collection, use, or sharing of personal information through its websites or applications, including cookies and similar tracking technologies, which are addressed in TEKPOLY’s separate Cookie Notice and Privacy Policy.
4.2 Order Acceptance, Pricing, and Errors
All orders are subject to acceptance and availability and are final, non-cancellable, and non-refundable except as expressly provided in this Return Policy, Limited Warranty, or as required by applicable law. TEKPOLY reserves the right, at any time and without prior notice, to:
4.3 Shipping, Delivery, and Risk of Loss
Title and risk of loss for TEKPOLY physical products pass to you upon delivery to the carrier for shipment to the address you provide, except where applicable law requires otherwise. TEKPOLY is not responsible for delays caused by the carrier, customs, force majeure, or incorrect address information provided by the customer. If a shipment arrives visibly damaged or is lost in transit by TEKPOLY’s designated carrier, notify TEKPOLY Customer Support within the timeframes published in our shipping documentation so that a replacement or refund can be arranged.
4.4 Intellectual Property
All trademarks, service marks, trade names, logos, product designs, packaging, copyrights, patents, and other intellectual property rights associated with TEKPOLY products and materials are owned by or licensed to TEKPOLY and are protected by United States and international intellectual property laws. Nothing in this Policy or in your purchase of a TEKPOLY product grants you any right or license to use any TEKPOLY intellectual property except for personal, non-commercial use of the product itself in accordance with its intended purpose. TEKPOLY shall have no liability to you if any product infringes or is alleged to infringe any rights (including intellectual property rights) of any third party, except to the extent expressly required by applicable law.
4.5 Governing Law and Venue
This Policy and any dispute arising out of or relating to the purchase, ownership, or use of a TEKPOLY physical product shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to Section 4.6, the state and federal courts located in Delaware shall have exclusive jurisdiction and venue over any such dispute, and you consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
4.6 Informal Dispute Resolution
Before initiating any formal proceedings, you agree to first contact TEKPOLY Customer Support and provide a written description of the dispute, your contact information, and the relief you seek. The parties will attempt in good faith to resolve the dispute informally for a period of at least sixty (60) days before either party may initiate formal proceedings.
4.7 Severability; No Waiver; Entire Agreement
If any provision of this Policy is held unlawful, void, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable and the remaining provisions shall remain in full force and effect. TEKPOLY’s failure to enforce any right or provision shall not constitute a waiver of that right or provision. This Policy, together with any product-specific terms, warranty cards, user manuals, and TEKPOLY’s published Terms of Sale, Cookie Notice, and Privacy Policy, constitutes the entire agreement between you and TEKPOLY regarding the subject matter hereof and supersedes any prior or contemporaneous understandings.
4.8 Updates to This Policy
TEKPOLY may update, revise, or modify this Policy from time to time. Updates take effect on the “Effective Date” listed at the top of the then-current version posted at tekpoly.com. The Policy in effect on the date of your purchase will govern that purchase, except where a later version is more favorable to you or where applicable law requires application of an updated version.
